2. USERS

Your access and use of the Ractem website is conditional on you being a USER who has accepted, upon such access or use, the present Policy.

This Policy will apply independently of the General Terms and Conditions, which are also mandatory.

ractem.ie provides the USER with access to a variety of online information, services, programmes and data (hereinafter ‘content’) that belong to Ractem or its licensors.

Upon such registrations, the USER will be responsible for lawfully providing true and accurate information. The USER also commits to using the content and services that Ractem offers via the website (such as the chat service) in an appropriate manner and not, by way of illustrative and non-exhaustive example, to:

  • Involve themselves in activities that are illicit, illegal, in bad faith or that undermine public order.
  • Spread propaganda or content that is racist, xenophobic, sexual or that supports terrorism or affronts human rights.
  • Cause damage to the physical or information systems belonging to Ractem, their providers or third parties, or introduce or spread viruses into the network or any other physical or information system that may be susceptible to damage of the aforementioned kind.
  • Try to access and/or use the email accounts of other users and modify or manipulate their messages.

Ractem reserves the right to remove all those comments and remarks that infringe upon the dignity and respect of a person, whether they be discriminatory, xenophobic, racist, pornographic, violative of young people, children, public order or security, or otherwise inappropriate for publication in Ractem’s judgement.

In any case, Ractem is not responsible for opinions that users disseminate via the chat or other features of which they make use.

What is the purpose of the data processing?

Ractem Sistemas S.L. can process your personal data for the following purposes:

  • Contractual purposes: The processing is carried out exclusively to manage our commercial relationship. In no way will your data be used to create profiles or automate decisions.
  • Purposes that require your consent: Your data is processed so that we can send the information requested via the appropriate means.

How long will your data be kept for?

Personal data provided to facilitate quotes, preliminary contracts or information requests will be kept for a period of one year.

The personal data provided to manage your purchases will be kept for a period of four years, starting from the last service provided, so that we can comply with any obligations or requirements imposed by Public Authorities.

What is the legal basis for the data processing?

When it comes to our commercial relationship, the legal basis for processing your data is the performance of a contract. You will have to provide the information required to formalise and document our commercial relationship and comply with legal obligations. This is a necessary requirement for you to be party to an agreement, which will otherwise be prevented by a lack of specific information.

In other cases, such as when fulfilling requests for information, the basis is your express consent.

Where will your data be sent?

The data you provide are exclusively used to maintain and manage our relationship in accordance with our contract or preliminary contract. They will not be handed over to third parties under any circumstances, except to Public Authorities in cases where such action is required by law.

  • Your right to data portability is a more specific form of your right to access your personal data, using which you can request a digital copy of the personal data that are processed. The data will be provided in an Excel format.

Attach a copy of an identity document that proves that you are who you say you are, and send the form to RACTEM SISTEMAS, S.L.

If you use the first method, we will respond via email, which will let you verify the date and content of the request. For the second method, we will send a letter to the address stated as the return address.

Where can you turn in the case of a dispute?

You can present your claim to the Spanish Data Protection Agency, especially if you feel dissatisfied when trying to exercise your rights.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY

Whether on its own account or via licensees, Ractem is the holder of all intellectual and industrial property rights pertaining to its website, as well as the content displayed on the website (including, by way of example, images, sounds, audio, video, software, text, branding, logos, colour combinations, structure and design, the use of selected materials and computer programs required for it to function, be accessed, be used, etc.). Ractem reserves all rights.

In accordance with the stipulations of Articles 8 and 32.1, Paragraph 2 of the Law on Intellectual Property, the reproduction, distribution and publication of the whole or any part of the website for commercial purposes is expressly prohibited without prior authorisation from Ractem, regardless of device or technical means used.

The USER commits to respecting the Intellectual and Industrial Property rights of Ractem. They may display elements of the website and even print, copy or store them on their hard drive or other physical storage device whenever they like, but only and exclusively for their own personal, private use.

The USER must refrain from deleting, altering, circumventing or manipulating any of the security devices or systems that may be installed on Ractem webpages.
